These conditions apply to every vehicle rental arranged by ALKA Investment - FZCO (trading as ALKA Rent A Car), licence No. 70829 issued by IFZA, Dubai, registered at IFZA Business Park, DDP A2, Dubai Silicon Oasis, Dubai, United Arab Emirates.
Your rental is governed by these conditions, by your booking confirmation and by the rental agreement signed before handover. Together they form the contract. Amounts specific to your rental, including the daily rate, the security deposit, the insurance excess, the excess mileage rate, delivery and collection charges and administrative fees, are set out in your booking confirmation and in the rate sheet in force at the time of booking.
Where the vehicle is supplied by a partner fleet operator, that operator is identified in your booking confirmation and these conditions apply to that rental in the same way.
The renter and every driver must, before handover:
Tell us the date your licence was issued when you book. If it was issued less than six months before the rental, insurance cover may be reduced: in an at-fault accident you may be responsible for the excess plus a share of the claim, as set out in section 9 and in your booking confirmation. Some vehicle classes are not released to newly licensed drivers at all.
Only drivers named in the rental agreement may drive the vehicle. Because the insurance is issued in the named driver's name, every additional driver must be registered, verified and added to the policy at the start of the rental; a driver cannot be added once the rental has begun, and additional drivers are charged at the rate shown in your booking confirmation. Allowing an unnamed person to drive is a serious breach: it voids insurance cover and makes you liable for all resulting loss.
The minimum rental period is 2 days. A rental day is 24 hours from the time of handover. Rates are quoted in UAE dirhams and value added tax is added at the rate in force, currently 5 per cent.
The rental charge is payable before handover unless your booking confirmation states otherwise. Extras, tolls, fines, fuel, mileage in excess of the allowance, damage and administrative fees are charged during or after the rental as they arise.
You authorise us to charge the payment card registered on the booking for any amount properly due under this contract, including amounts identified after the vehicle is returned. We will tell you what we are charging and why, with supporting evidence, before or at the time of charging.
A security deposit is taken as a pre-authorisation hold on your card before handover. The amount depends on the vehicle class and is shown in your booking confirmation. The funds are held by your bank, not transferred to us, unless we later charge against them. The deposit secures traffic and RTA fines, damage that insurance does not cover, and theft.
The hold is released after the vehicle is returned and inspected, subject to any deduction for fuel, mileage, damage, fines, tolls or other amounts due. A card hold is kept for up to 21 days and is then released by your bank, which controls the timing. Where a deposit was paid in cash, it is refunded within 30 days of return and any bank transfer charge is borne by the customer.
We may take a further hold or increase the deposit where the rental is extended, where an incident occurs, or where fines or tolls are outstanding.
The rental includes 250 kilometres per day, calculated over the whole rental period. Kilometres driven in excess of the allowance are charged per kilometre at the rate for the vehicle class stated in your booking confirmation.
The odometer reading is recorded at handover and at return, and both readings appear in the handover reports that you sign. Tampering with the odometer terminates the rental immediately and makes you liable for all resulting loss.
The vehicle is delivered with a full tank or a full charge and must be returned in the same condition. If it is not, we refuel or recharge the vehicle and charge you the cost plus the service fee shown in your booking confirmation.
Use only the fuel type or charging standard specified for the vehicle. Misfuelling is not covered by insurance and you are responsible for the full cost of recovery and repair.
The vehicle may be driven only on paved public roads within the United Arab Emirates. Taking the vehicle outside the United Arab Emirates, including into the Sultanate of Oman, is strictly prohibited and is not covered by insurance.
Off-road use, driving on sand, beaches, sabkha, salt flats, unpaved tracks or flooded roads is prohibited, as is transporting the vehicle by sea, air or transporter without our written consent.
Breach of this section voids insurance cover, makes you liable for the full value of any loss or damage, and entitles us to recover the vehicle and terminate the rental immediately.
The vehicle must not be used:
Cleaning charges apply where the vehicle is returned in a condition that requires more than normal valeting, including smoke, animal hair, sand, spillage or odour. The applicable charge is shown in your booking confirmation.
Breach of this section entitles us to terminate the rental immediately, recover the vehicle, retain the deposit to the extent of our loss and recover any further loss from you. Insurance cover does not apply to loss arising from prohibited use.
Every vehicle is insured in accordance with UAE law. The cover, the insured value and the excess (the amount you pay towards each claim) depend on the vehicle class and are stated in your booking confirmation. Where offered, an excess reduction option may be purchased before handover.
Insurance does not cover, and you remain fully liable for, loss or damage arising from: driving by an unnamed or unqualified driver; driving under the influence of alcohol or drugs; use in breach of section 7 or section 8; wilful damage or gross negligence; leaving the vehicle unlocked or with the keys in it; loss of keys or documents; damage to tyres, wheels, glass, undercarriage or interior where excluded by the policy; and any incident not reported to the police where a police report is required.
Newly licensed drivers: where the driving licence was issued less than six months before the rental, the insurer applies reduced cover. In an at-fault accident the driver pays the excess plus 10 per cent of the assessed claim, and a Dubai Police report is required in every case. This is stated again in your booking confirmation when it applies to you.
You must not admit liability, agree a settlement or authorise a repair on our behalf without our written consent.
If the vehicle is involved in an accident, is stolen, is damaged or breaks down you must:
Failure to obtain a police report or to notify us in time makes you liable for the full cost of the damage, loss of use, recovery, and any resulting claim, regardless of who caused the incident.
Roadside assistance is available for mechanical breakdown. Assistance needed because of misuse, misfuelling, a lost key, a flat battery caused by leaving equipment on, or a puncture is chargeable.
You are responsible for every traffic fine, parking fine, impound charge and toll incurred during your rental period, together with any charge imposed by an authority in connection with the vehicle while it was in your possession.
Salik toll crossings are charged at the actual amount levied by the authority. Fines are charged at the amount levied plus the administrative fee stated in your booking confirmation, which covers the manual work of identifying, evidencing and settling each fine with Dubai Police or the Roads and Transport Authority.
Fines are often notified to us weeks or months after a rental ends. You authorise us to charge your registered card for these amounts when they are notified to us, and we will send you the evidence for each charge. Black points and any driving ban remain the responsibility of the driver.
Delivery and collection are available at the locations and charges shown during booking. Please allow reasonable time for the handover inspection, which is documented with photographs and signed by both sides.
The vehicle must be returned at the agreed time, to the agreed place, with all keys, documents, accessories and equipment, in the same condition as at handover, fair wear and tear excepted. Missing or damaged accessories are charged at the replacement cost shown in your booking confirmation.
If you return the vehicle late without agreement, we charge for the additional time at the rate in your booking confirmation, and you remain responsible for the vehicle until it is returned. Persistent failure to return the vehicle entitles us to recover it, to charge the cost of recovery, and to report the vehicle as unlawfully retained.
To extend a rental you must contact us before the return time and obtain written confirmation. Extension depends on availability, a valid deposit hold and payment for the additional period.
Cancellation and no-show terms depend on the vehicle class and, where the vehicle is supplied by a partner operator, on that operator's terms. Cancellation must reach us at least 24 hours before the agreed pickup time. Eligible refunds are returned to the original payment method, normally within 7 to 10 business days. Any further terms that apply to your rental are shown before you pay and repeated in your booking confirmation.
If you do not collect the vehicle within the period stated in your booking confirmation, and have not told us, the booking is treated as a no-show and the applicable charge is retained.
If you return the vehicle early, the rental period already booked remains payable unless your booking confirmation states otherwise, because the vehicle was withdrawn from availability for that period.
We may cancel a booking where identity verification fails, where the deposit cannot be secured, where the documents presented do not match the booking, or where we reasonably suspect fraud or a risk to the vehicle or to people. Where we cancel without fault on your part, we refund amounts paid for that booking.
Do not leave valuables in the vehicle. We are not responsible for loss of or damage to property left in, on or delivered with the vehicle, except where the loss is caused by our negligence. Property found after return is held for a reasonable period and then disposed of.
Nothing in these conditions excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of a business opportunity, loss of enjoyment or wasted expenditure, and our total liability in connection with a rental is limited to the total charges paid for that rental.
Neither party is liable for failure or delay caused by events outside its reasonable control, including extreme weather, sandstorm, flood, fire, epidemic, civil unrest, strike, act of government, road closure or failure of public infrastructure.
We process your data as set out in our Privacy Policy, including for identity verification, insurance, fines and tolls. Where an authority requires the identity of the driver at a given time, we are obliged to provide it.
This contract is governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have exclusive jurisdiction over any dispute arising from it.
These conditions are published in English, German, Turkish and Arabic, with identical numbering. The English version prevails in the event of any discrepancy, except where mandatory law requires otherwise.
If any provision is held invalid or unenforceable, the remaining provisions continue in force. No delay in enforcing a right is a waiver of it. This contract is the entire agreement between us in relation to the rental and replaces any earlier discussion or representation.
